The right of a party to an action in which orders have been made, to apply for further orders without requiring the leave of the court to make the application. Parties may seek from a court liberty to apply when a matter is stood over generally. If granted, it means that the court will allow the matter to resume before the court (if a party applies) without the need to commence a new matter procedurally. If a matter before the court is of an urgent nature, it may be adjourned (or stood over) to a specific date with liberty to apply. That means that either party can apply to have the matter listed before the adjourned date if necessary. A ‘liberty to apply’ provision in a consent order confers on the judge the power to construe the terms of the consent order and decide on their true meaning and effect: Leung Yee & Anor v Ng Yiu Ming & Anor [2001] 1 HKC 342 (CA). Liberty to apply may be implied from the terms of the consent order: Atkinson v Castan (Times, 17 April 1991, unreported).
爭議某方有權在已作出命令的訴訟中,在無需法庭給予申請許可的情形下,作出進一步的命令申請。一般就延緩處理的事宜,各方可向法庭尋求提出申請的自由。如批予,法庭將准予事宜在法庭上恢復(如某方提出申請),而無須在程序上提起新的事宜。如在法庭的某事宜乃屬緊急性質,可藉提出申請的自由,申請押後(或延緩處理)到指定日期。意思是任何一方如有需要,可申請在押後日期前的日期排期聆訊。在同意下作出的命令中的「提出申請的自由」條文,賦予法官解釋該命令所包含的條款之權力,並就他們的真正含意及效力作出裁決:Leung Yee & Anor v Ng Yiu Ming & Anor [2001] 1 HKC 342(上訴法院);提出申請的自由可隱含在在同意下作出的命令條款中:Atkinson v Castan(《時代日報》1991年4月17,未經彙報)。
