释义 | 意見 The advice or opinion of a barrister expressed in conference or in writing. Generally counsel’s advice sought for the purpose of giving legal advice to the client is privileged from disclosure. However, an opinion given by a barrister in his capacity as a friend is not privileged from disclosure: Smith v Daniell (1874) LR 18 Eq 649. Counsel’s mistaken advice does not negative a solicitor’s prior negligence. If a solicitor does not supply counsel with material information which would, if known to counsel, have altered his opinion, the opinion of counsel does not protect the solicitor: Ireson v Pearman (1825) 5 Dow & Ry KB 687.
