释义 | 合理租金 Rental for prescribed premises determined under the fair rents legislation. In Hong Kong, controls over rent are provided in the Landlord and Tenant (Consolidation) Ordinance (Cap 7). The level of control varies, depending upon which part of the Ordinance applies to the tenancy in question. For tenancies under Part I of the Ordinance (pre-war domestic tenancies), the amount of rent after 30th June 1996 will be 85 times the standard rent of the premises or 90 percent of the prevailing market rent of the premises, whichever is higher. Nevertheless, the amount of rent can be altered upon the agreement of the landlord and tenant. The landlord can also increase rent in other ways subject to statutory provisions. For tenancies under Part II of the Ordinance (post-war domestic tenancies), rent control takes form of restrictions on the rate of increase. Unlike tenancies under Part I, there is no cap on the initial amount of rent. The rent can be increased or decreased by agreement of the landlord and tenant. Rent can be increased on account of improvements, on account of rates or by applying for a certificate of increase in rent issued by the Commissioner of Rating and Valuation. As to tenancies under Part IV (post-war domestic tenancies) and Part V (business tenancies) of the Ordinance, there is no rent control. However, for Part IV tenancies, a tenant can apply for a fresh tenancy at the prevailing market rent: Halsbury’s Laws of Hong Kong, Vol 17, Landlord and Tenant [235.194].
