释义 | 非法解僱 The termination by an employer of the employment of an employee otherwise than in accordance with the terms of the contract of employment, or in contravention of an award or statute applying to the employment. Wrongful dismissal may consist of not giving an employee proper notice: Lui Lim v Po Shek Restaurant Ltd [1966] HKDCLR 77. However, a dismissal with wages in lieu is not a wrongful dismissal such as to relieve the employee of a restraint clause: Rex Stewart Jeffries Parker Ginsberg Ltd v Parker [1988] IRLR 483 (CA). An employee who has been wrongfully dismissed has a cause of action against the employer: Stapp v Shaftesbury Society [1982] IRLR 326 (CA). An employee’s statutory entitlements are not adversely affected where an employer wrongfully terminates an employee’s employment. In such circumstances, statutory benefits, including a long service payment (Employment Ordinance (Cap 57) s 31T(1)(a)), severance payment (s 31D(1)(a)), proportional end of year payment (s 11F(1)(a)), annual leave pay (s 41D(1)), proportional annual leave pay (s 41D(2)), holiday pay (s 40A), maternity leave pay (s 15(2), (3)), sickness allowance (s 33(4B)) and outstanding salary or wages will be payable. The employee’s action is for breach of contract, so there is an obligation on him to take reasonable steps to mitigate any loss: British Westinghouse Electric and Manufacturing Co Ltd v Underground Electric Rly Co of London Ltd [1912] AC 673 (HL).
