Fair wear and tear |
The deterioration of premises due to both reasonable use and ordinary operation of natural forces. It is a common feature for a lease to include a covenant that the tenant will keep the premises in good repair and condition with the exception of damage and dilapidations resulting from fair wear and tear. However, the tenant may be liable for failure to prevent damage consequent upon damage due to fair wear and tear: Haskell v Marlow [1928] 2 KB 45. The question whether wear and tear is fair is not affected by the amount of dilapidation. If the passage of time and the operation of the elements have a more deteriorating effect than usual because of the original unsoundness of the premises, the tenant is not liable for the resulting dilapidations: Halsbury’s Laws of Hong Kong, Vol 17, Landlord and Tenant [235.307]. See also Covenant; Dilapidation; Reasonable wear and tear. 另見 Covenant; Dilapidation; Reasonable wear and tear。 |
