1. The initiation of proceedings based on an allegation of contempt of court. The power to commence such proceedings is instituted by the court, being any tribunal or person having power to punish for contempt (High Court Ordinance (Cap 4) s 50), or the Attorney-General, being the Secretary for Justice in Hong Kong. 2. Contempt proceedings, both civil and criminal, are by way of committal and governed by the rules of court: Interpretation and General Clauses Ordinance (Cap 1) s 3. It is civil contempt to refuse to neglect to carry out an act required by a judge or order of the court within the time specified therein: The Rules of the High Court (Cap 4A) O 42 r 2(1); O 26 r 6. It is, inter alia, contempt to resist or obstruct a bailiff in the execution of his duty: Summary Offences Ordinance (Cap 228) s 23; R v Sun Yue Yen [1964] HKLR 139. The overall court order; to prevent actions which threaten the due administration of justice; or to prevent a threatened contempt.
