The rule that where a solicitor-trustee is acting in litigation on behalf of himself and his co-trustees, he can claim costs up to the limit that he will charge if he has been acting for the co-trustees alone. It is an exception to the principle that the office of a trustee shall not profit from the trust property: Cradock v Piper (1850) 1 Mac & G 664. See also Cestui que trust; Commission; Trustee. |
