At an auction, a person who makes an offer to purchase the property auctioned at a certain price. There is no requirement at common law as to how a bid should be made, but the onus is on the bidder to ensure that an effective bid is made and that it is communicated to the auctioneer: Richards v Phillips [1968] 2 All ER 859, [1969] 1 Ch 39 (CA). In a public auction announced to be without reserve, the highest bidder has a legal remedy against the auctioneer who has accepted his bid without the authority of the vendor: Kwok Lai Ting v Hughes & Hough [1922] 17 HKLR 51.
