| 释义 | 工作 1. Effort or energy exerted to achieve a result; labour. 2. That on which effort is expended; something to be done. For example, building works, and the supply of manual labour for the purposes of or in connection with building works: Employment Ordinance (Cap 57) s 43A(1). It includes building and construction work, electrical work, gas installation work; work done in a relationship of employment, work under a contract for services, work remunerated wholly or partly by commission. Intellectual property - A copyright work, which includes an artistic, dramatic, literary, or musical work; or work of joint authorship: Copyright Ordinance (Cap 528) ss 2-5. For something to be qualified as a ‘work’, sufficient skill, labour, judgment, capital, literary skill or taste, or knowledge must have gone into the creation of it: British Leyland Motor Corp Ltd v Armstrong Patents Co Ltd [1986] AC 577, 2 WLR 400, 1 All ER 850 (HL); Interlego AG v Tyco Industries Inc [1989] 1 AC 217, [1988] 3 All ER 949 (PC).
