| 释义 | 工作及材料合約 A contract in which the substance of the bargain is the skill and labour involved in the production of the article the subject of the contract, and where the transfer of materials in addition to the skill involved is merely ancillary: Robinson v Graves [1935] 1 KB 579. In building law, a building contract which at common law implies terms in respect of the fitness and quality of materials, correspond to the terms implied in the case of a sale of goods: Independent Broadcasting Authority v EMI Electronics Ltd & BICC Construction Ltd (1980) 14 BLR 1 (HL).
