A magnetised plastic card issued usually by a bank (the issuer) to approved creditworthy persons (the cardholders) which allows the cardholders to obtain cash advances or to purchase goods or services up to a specified limit from retailers or service providers (the merchants) without having to pay cash immediately. Each card is on its front embossed and encoded by the issuer with the holder’s name and number and bears on its back a specimen signature of its holder. The cardholder can only use the card to purchase goods or services from the merchants which display the issuer’s insignia or logo. The merchants have to obtain authorisation from the card centres before they supply the goods or services against the sale slip signed by the cardholder. By signing the sales slip the cardholder offers to borrow the price of the goods or services purchased from the issuer. The merchants receive payment from the issuer who obtains reimbursement from the cardholder. The cardholder receives regular statements and may pay the balance in full, or in part subject to a certain minimum (usually 5% of the full statement amount due). Interest is payable on the outstanding balance at the pre-agreed rate. The first credit card programme in Hong Kong was launched in 1974 by the Bank of America. In Hong Kong, there is no statute specifically regulating credit cards where the credit card business is carried on by a bank, such business will be regulated together with the bank’s other business under the Banking Ordinance. There are rules relating to credit cards stated in the Code of the Banking Practice which was first issued in 1997 jointly by the Hong Kong Association of Banks and the Hong Kong Association of Restricted Licence Banks and Deposits-taking Companies.
