释义 | 品格證據 Evidence of a person’s honesty, reliability or personality. Typically, if such evidence were to be adduced, the purpose would be to show the credibility and reliability of a witness or of the defendant or to show the propensity of the defendant committing the offence charged. At common law, the prosecution cannot adduce evidence tending to show the defendant to be a person of bad character, except in rebuttal to evidence of good character led by the defence: Halsbury’s Laws of Hong Kong, Vol 12, Evidence [175.322]. On the other hand, the defendant can adduce evidence of his own good character. Evidence may be adduced to show that the character of a witness to be such as to make his/her testimony less credible. However, the trial judge retains a discretion to disallow purely vexatious cross-examination or any irrelevant evidence on the witness’ character.
