释义 | 工作的權利 1. An entitlement of an employee to have work provided by his or her employer. There is no right to work at common law; an employer may refuse to give an employee any work, as long as the employer continues to pay the employee’s wages. The existence of an implied term in the employment contract establishing a right to be provided with work has been suggested: Langston v AUEW [1974] 1 All ER 980. 2. The right to the opportunity to gain one’s living by work freely chosen or accepted. An entitlement to work in one’s chosen trade or profession without being unjustly or arbitrarily excluded from it, as by a professional association (Nagle v Feilden [1966] 2 QB 633) or a trade union. The right to work is recognised in the International Covenant on Economic, Social and Cultural Rights (ICESCR). The Basic Law states that Hong Kong residents 1 will have freedom of choice of occupation: Basic Law art 33. Appropriate steps will be taken by the state to safeguard this right: ICESCR art 6(1). The steps to be taken by the state to achieve the full realisation of this right include technical and vocational guidance and training programmes, policies and techniques to achieve steady economic, social and cultural development and full and productive employment under conditions safeguarding fundamental political and economic freedoms to the individual: ICESCR art 6(2).
