| 释义 | 錯對測試 A test derived from M’Naghten’s case used to determine the power of an apparently insane person to distinguish between right and wrong in his or her actions: M’Naghten’s Case (1843) 10 CL & Fin 200, 3 ER 718, [1843] All ER Rep 229 (HL). For this purpose, a person knows that an act is wrong if he knows that it is contrary to law: R v Holmes [1953] 2 All ER 324, 37 Cr App Rep 61 (CCA). The test is whether the act is right or wrong according to the standard accepted by reasonable men: M’Naghten’s Case, supra; R v Codere (1916) 12 Cr App Rep 21 (CCA). The defence of insanity does not apply to the case of an accused who knew what he was doing and that it was wrong, but was unable, owing to disease of the mind, to prevent himself from doing what he did.
