释义 | 土地押記 An interest in land to secure payment of money or performance of an obligation. A charge is a hypothecation, meaning that it merely acts as an encumbrance on title. It involves no transfer of a proprietary interest in, or of possession of, the property as security for loan. Instead, the property is merely designated as that which can be taken in execution of the debt on default. In general the three main differences between the charge and the mortgage over land are: (1) the charge does not involve the assignment of legal estate, and the chargor retains ownership of the property, and technically an equity of redemption as a right to redeem is unneccessary; (2) the chargor remains liable to the Government for rent and the observance of the covenants in the Government lease; and (3) the only remedy available to the chargee on chargor’s default is that of judicial sale: Sihombing & Wilkinson A Student’s Guide to Hong Kong Conveyancing (2nd Ed) ch 13 pp 759-760.
