| 释义 | 法案 A legislative document in the form of a proposed statute. The power of the Legislative Council of the Hong Kong Special Administrative Region to enact laws is set out in the Basic Law: Basic Law arts 17, 66, 73(1), 74. Every statute originates in a Bill which is presented to the Legislative Council according to the requirements laid down in the Rules of Procedures of the Legislative Council: r 50(1). The Bill is then read three times, and is sometimes passed into the committee stage after the second reading: rr 53-55. A Bill passed by the Legislative Council may take effect only after it is signed and promulgated by the Chief Executive: Basic Law art 76; and such power of the Chief Executive is a substantive one. If the Chief Executive considers that a Bill passed by the Legislative Council is not compatible with the overall interests of the Region, he may return it to the Legislative Council within three months for reconsideration. If the Legislative Council passes the original Bill again by not less than a two-thirds majority of all the members, the Chief Executive must sign and promulgate it within one month: Basic Law art 49. If he refuses to sign a Bill passed the second time by the Legislative Council, and if consensus still cannot be reached after consultations, the Chief Executive may dissolve the Legislative Council. The Chief Executive must consult the Executive Council before dissolving the Legislative Council. He or she may dissolve the Legislative Council only once in each term of his or her office: Basic Law art 50. The Chief Executive may also exercise this power of dissolution if the Legislative Council refuses to pass a budget or any other important Bill introduced by the Government: art 50.
