释义 | 海事司法管轄權 The admiralty jurisdiction of the Court of First Instance is chiefly statutory, in addition to the inherent jurisdiction of the Court of First Instance under its admiralty jurisdiction. The admiralty jurisdiction can be invoked in respect of any ship which is physically within the territorial waters of Hong Kong, whatever their nationality, or the domicile or residence of their owners. The subject-matter over which the Court of First Instance may exercise the admiralty jurisdiction is set out in detail in the High Court Ordinance (Cap 4) s 12A. It is extended to proceedings under the Merchant Shipping Ordinance (Cap 281); the Merchant Shipping (Safety) Ordinance (Cap 369); the Merchant Shipping (Liability and Compensation for Oil Pollution) Ordinance (Cap 414); the Merchant Shipping (Registration) Ordinance (Cap 415); the Merchant Shipping (Limitation of Shipowners Liability) Ordinance (Cap 434) and the English Merchant Shipping Acts 1894-1988 in their application to Hong Kong SAR. 高等法院的海事管轄權主要是法定的,但其亦有本身在海事管轄權方面的權力。不論船主的國藉、本籍或居所,船舶在香港的領海範圍內受海事司法管轄權覆蓋。原訟法庭可行使其海事司法管轄權的範圍已詳列於《高院條例》(第4章)第12A條。該範圍也包括根據以下法例所提出的法律程序:《商船條例》(第281章);《商船(安全)條例》(第369章);《商船(油類污染的法律責任)條例》(第414章);《商船(註冊)條例》(第415章);《商船(限制船東責任)條例》(第434章),及適用於香港特別行政區的1894-1988年英國商船法令。 |
