A formal document issued by the carrier to the shipper of goods stating that certain specified goods have been shipped in a particular vessel, and setting out the terms on which the goods are delivered to and received by the vessel: Sewell v Burdick (1884) 10 App Cas 74 (HL); Halsbury’s Laws of Hong Kong, Vol 18(1), Maritime Law [250.772]. 2. Any document which bears the signature of the owner, charterer, agent or master of a ship; or the owner, hirer or person in charge of a vehicle; and records particulars of a contract for the consignment of cargo in a vessel or vehicle: Import and Export Ordinance (Cap 60) s 2. A bill of lading is conclusive evidence against the carrier of the shipment of the goods or, as the case may be, of their receipt for shipment: Bills of Lading and Analogous Shipping Documents Ordinance (Cap 440) s 6. A bill of lading serves the following functions: it is a receipt for the goods shipped and prima facie evidence of the quality and condition of the goods when put on board; it is evidence of the carriage contract; it is a document of title to the goods shipped: Halsbury’s Laws of Hong Kong, Vol 18(1), Maritime Law [250.786 et seq].
