释义 | 違法作為 An action that infringes a statutory or common law prohibition. In order to constitute an offence under the criminal law, an unlawful act must amount to more than a tort and must be a breach of the criminal law: R v Lamb [1967] 2 QB 981, 2 All ER 1282. A killing in the course of a lawful contest is not an unlawful act unless the act which kills is intended to cause serious injury or the accused is indifferent and reckless as to the consequences: R v Young (1866) 10 Cox CC 371. A person who knowingly aids another person to do an unlawful act will be treated as doing an unlawful act of the like description: Disability Discrimination Ordinance (Cap 487) s 49(1).
