释义 | 截停及搜查 To interrupt a person’s progress and examine his or her clothing or property. The power to stop and search is not in the nature of an arrest: Daniel v Morrison (1979) 70 Cr App Rep 142 (DC). Legislation permitting the police to stop and search a person must be strictly complied with because there is no power to stop and search a person at common law (Kenlin v Gardner [1967] 2 QB 510, [1966] 3 All ER 931 (DC)) unless the person is simply stopped by the police in order to speak to him (Daniel v Morrison, supra). A police officer is only empowered to stop a person to seek production of an identity card but if the person behaves in a suspicious manner or the police officer reasonably suspects that the person has committed, is about to or intends to commit an offence then a search may be carried out: Police Force Ordinance (Cap 232) s 54. An officer of the Customs and Excise Service is empowered to stop and search anyone who he may reasonably suspect of committing an offence against the Customs and Excise Service Ordinance: Customs and Excise Service Ordinance (Cap 342) s 17A, sch 2. Additional stop and search powers are given to the Customs and Excise Service in relation to offences under the Import and Export Ordinance in relation to persons leaving and arriving in Hong Kong: Import and Export Ordinance (Cap 60) s 20(1)(g).
