释义 | 傳票 1. A document issued from the office of a court, calling upon the person to whom it is directed to attend before a judge or officer of the court for a certain purpose. A court may issue a summons to a person requiring him to attend before the court and give evidence or produce any document or thing specified in the summons: Criminal Procedure Ordinance (Cap 221) s 34. 2. In magisterial practice, a summons is the ordinary way of compelling the appearance of a person against whom a complaint, information or other proceedings has been brought: Magistrates Ordinance (Cap 227) s 8. 3. In both the Court of First Instance and the District Court a summons may be a summons in a pending cause or matter. Every other summons is an originating summons: The Rules of the High Court (Cap 4A) O 1 r 4(1). A summons other than an originating summons is a mode of making an application to a judge or master in chambers. They are therefore only used on application which are either of subsidiary importance or which can be conveniently disposed of in chambers, such as applications for enlarging the time to take certain steps, for discovery and production of documents.
