| 释义 | 家事調解 An alternative service to court proceedings available to parties when instituting matrimonial proceedings. Its aim is to help separating or divorcing couples to resolve their problems without the need for expensive litigation, so that they reach their own mutually acceptable agreements regarding the on-going arrangements for their children and the resolution of financial matters. In family mediation, a Mediation Co-ordinator holds information sessions and assists couples in resolving their problems by assisting them to communicate and negotiate issues in a confidential manner. The information sessions provided by the Mediation Co-ordinator’s Office are free of charge. The Mediator does not provide legal advice nor takes sides. The parties may be referred to mediation upon institution of the proceedings, or after litigation has commenced. Both parties have the right to terminate the family mediation at any time and they must appreciate that what the other party says in a family mediation session cannot be used in any legal proceedings. However, an application for family mediation does not lead to an automatic stay in the litigation proceedings. The advantages of family mediation include: the parties may avoid the tension and conflict in adversarial litigation in court and they may save some time and money. However, family mediation may not be appropriate for all disputes, such as child abuse and domestic violence, as fear may prevent one party from negotiating freely. A pilot scheme for family mediation was launched by the judiciary on 2 May 2000 and was formally adopted to take effect on 1 August 2003. 在提起婚姻法律訴訟程序時，可供各方使用以替代法律程序的服務。目的在於可在無需承擔昂貴訴訟費用的情況下，協助分居或離婚的伴侶解決他們的問題，因而他們可就其子女的持續安排達致雙方可接受的協議及解決財務事項。就家事調解而言，調解統籌員舉行資料會議，並藉協助有關的伴侶在保密的情況下互相溝通及商議問題協助解決他們的問題。調解統籌員辦事處提供的資料會議是免費的。調解員不會提供法律意見，亦不會有所偏袒。一旦提起有關的法律訴訟或在訴訟已展開後，各方可轉介予家事調解。雙方均有權在任何時間終止有關的家事調解，而他們須了解，另一方在家事調解會所述的事項不可在任何法律程序中使用。但家事調解的申請不會導致訴訟程序自動擱置。家事調解的優點包括：各方可避免在法庭上因對抗性訴訟而產生緊張狀態和衝突，此外，各方亦可節省時間及金錢。但並非所有的糾紛均適合以家事調解處理，例如虐待兒童和家庭暴力，因為恐懼可妨礙一方自由地商議。2000 年5月2推出家事調解的試驗計劃，並於年8月1日正式採納生效。 |
