| 释义 | 家庭供養 The order by the courts for provisions to be made out of the estate of a deceased person for certain members of that person’s family and dependants of that person. For a deceased person who died after 7 October 1971 and before 3 November 1995, the Deceased’s Family Maintenance Ordinance (Cap 129) (repealed) applies. For a deceased person who died on or after 3 November 1995, the Inheritance (Provision for Family and Dependants) Ordinance (Cap 481) applies. Application for family provision can be made by those persons who have the necessary capacity on the ground that the disposition of the deceased’s estate effected by his will or the law relating to intestacy, or the combination of his will and that law, is not such as to make reasonable financial provision for the applicant: Inheritance (Provision for Family and Dependants) Ordinance (Cap 481) ss 3-5. The courts’ power to order for family provision is discretionary: s 4(1). See Family Provision Application. 法庭就從某死者的財產當中撥出適當的財產給予該人的若干家庭成員或受養人作為供養而作出的命令。於1971年10月7日後及1995年11月3日前死亡的死者，《遺屬生活費條例》（第129章）（現已廢除）適用。於1995年11月3日當日或之後死亡的死者，《財產繼承（供養遺屬及受養人）條例》（第481章）適用。有所需資格的人士可持下述理由向法院申請作出家庭供養的命令︰依照死者遺囑或關於無遺囑繼承的法律，或綜合死者遺囑及該等法律而作出的遺產處置，並沒有為申請人提供合理經濟給養：《財產繼承（供養遺屬及受養人）條例》（第481章）第3至5條。法庭作出家庭供養的命令屬酌情決定權：第4(1)條。另見 Family Provision Application。 |
