释义 | 合理技巧和努力 A fair, proper and due degree of care and ability as might be expected from an ordinarily prudent person with the same knowledge and experience as the defendant engaging in the defendant’s particular conduct or omission and under the particular circumstances: Knight v Home Office [1990] 3 All ER 237. Reasonable skill and diligence is not a low or high level of skill and diligence, but rather that level of skill and care which is appropriate in the circumstances: Yue Xiu Finance Co Ltd v Agnew [1996] 2 HKC 122 (CA). A defendant must exercise such skill and diligence as a reasonable person under similar circumstances would employ to avoid acts or omissions which he or she reasonably foresees are likely to cause injury to others: Thomsen & Anor v Johnson Burglar Alarms Co Ltd [2001] 4 HKC 666. A person who fails to exercise reasonable skill and diligence may be guilty of negligence: Gill v Manchester Sheffield and Lincolnshire Rly Co (1873) LR 8 QB 186. The onus of proving negligence rests on the plaintiff.
