释义 | 合理的謹慎 The standard of care owed by those who have a duty to take care such as that owed by employers to their employees. In determining what constitutes reasonable care in a particular situation, regard should be had to: the degree of risk of an accident, the degree of injury likely to result from such an accident; and the nature and extent of the remedial action suggested. An employer has the duty to take precautionary measures to safeguard his employees from risk of injury: Wong Wai Ming v Hospital Authority [2000] 4 HKC 330. The degree of care required, however, varies according to the circumstances, and more than ordinary care is sometimes required. Negligence is failure to exercise reasonable care and reasonable skill: Stoomvaart Maatschappy Nederland v Peninsular and Oriental Steam Navigation Co (1880) 5 App Cas 876 (HL).
