释义 | 合理錯誤 An honest mistake of fact, based on reasonable grounds, which renders conduct innocent that would otherwise have legal consequences. An understandable or reasonable mistake of fact could be a defence but a criminally negligent or unreasonable mistake would not be: R v Lai (Dennis) (HCMA 184/95, unreported). Where such a defence is implied, the burden of proof is on the accused and the standard of proof required is proof on the balance of probabilities: A-G v Fong Chin Yue [1995] 1 HKC 21, 1 HKCLR 193.
