In criminal law, an element of several defences. A belief which is honestly held and held on reasonable grounds: IRC v Rossminster Ltd [1980] AC 952, 1 All ER 80 (HL). It requires not only that the person in question has reason to believe but also that he does actually believe: Nakkuda Ali v Jayaratne [1951] AC 66. For example, in relation to bigamy, an honest and reasonable belief in facts, which if true, would render his second marriage not bigamous is a defence: R v Gould [1968] 2 QB 65, 1 All ER 849 (CA). In relation to offences of strict liability, the law may, as a matter of construction, imply into the offences a defence of honest belief on reasonable grounds on facts which if true would make the act innocent: A-G v Fong Chin Yue [1995] 1 HKC 21, 1 HKCLR 193 (CA); HKSAR v Pat Kim Por [1999] 4 HKC 840.
