释义	合理理由 The motive for a person’s conduct or the basis for a state of mind (such as belief or suspicion) where, from an objective viewpoint, that motive or basis was just and appropriate in all the circumstances. For example in relation to a plea of self defence, the common law requires that the accused believed on reasonable grounds that the force used in self-defence was necessary: Devlin v Armstrong [1971] NI 13. In relation to plea of duress or compulsion which relies upon the accused’s belief of the threat, where the threats are not factually demonstrable, such belief has to be based on reasonable grounds: R v Graham [1982] 1 All ER 801, R v Howe, Bannister & Clarkson [1987] 1 AC 417, 1 All ER 771. Consent as a defence to prosecution for certain sexual offences, such as intercourse with a young person, may be based on the accused’s belief on reasonable grounds concerning the age of the person upon whom the offence is alleged to have been committed: Banks [1916] 2 KB 621. Having ‘reasonable grounds to believe’ involves subjective and objective elements. Objectively, it requires proof that there are grounds that a common-sense, right- thinking member of the community would consider sufficient to lead a person to hold a particular belief. Subjectively, it has to be proved that these grounds were known to the defendant. It is not necessary to prove that a reasonable man would have held to such a belief nor actual belief on the part of the defendants: Seng Yuet Fong v HKSAR [1999] 2 HKC 833 (CFA).
