The fair and proper belief, prospect, or probability that a dependant of a deceased would have been provided with a particular financial benefit or support had the deceased lived. A dependency claim is founded not on need or legal entitlement, but on reasonable expectation of future pecuniary benefits from the continuance of the life of the deceased: Buckland v Guildford Gas Light and Coke Co [1949] 1 KB 410. Once it is demonstrated that there was a reasonable expectation of support, the fact that the court must speculate as to the level of support is not an obstacle: Lindley v Sharp (1974) 4 Fam Law 90. Whether the expectation of financial benefit is reasonable is to be inferred from the surrounding circumstances. The expectation is reasonable where the deceased has earned money and financially contributed to the support of the dependant in the past: Taff Vale Railway Co v Jenkins [1913] AC 1.
