| 释义 | 合理依賴 Trust, confidence, or dependence which is reasonably established upon the advice or information of another, and which motivates a person’s acts or omission. Reasonable reliance is an essential element in establishing the existence of a duty of care in an action for negligent misstatement resulting in economic loss: Yuen Kun Yeu v A-G [1987] 2 HKC 25 (PC). Where a defendant makes a statement which is reasonably relied upon by a plaintiff (who may even be a third party), in the way intended by the defendant, with the resultant damage to the plaintiff, there may be an expressed or implied assumption of responsibility sufficient to give rise to liability for economic loss flowing from the reliance: Yue Xiu Finance Co Ltd v Agnew [1996] 2 HKC 122 (CA) ; Baron v Hartford Fire Insurance Co Ltd [1998] 1 HKLRD 411. In the case of solicitors negligently giving incorrect advice or information, it is sufficient for the plaintiff to prove that he relied on the negligent advice or information: Bristol and West Building Society v Mothew [1998] Ch 1, [1996] 4 All ER 698, [1997] 2 WLR 436 (CA). A plaintiff’s reliance will be reasonable where the statement is made on a serious occasion, and in relation to a serious matter. Statements made in the course of social intercourse with no thought of legal consequence are not treated as including reasonable reliance: Howard Marine and Dredging Co Ltd v A Ogden & Sons (Excavations) Ltd [1978] QB 574, 2 All ER 1134 (CA).
