释义 | 預定地役權 An easement which the law grants by implication in order to carry out the common intention of the parties to a grant of land: Jones v Pritchard [1908] 1 Ch 630; Pwllbach Colliery Co Ltd v Woodman [1915] AC 634. An intended easement may be implied in favour of a grantor over land conveyed to a grantee, but it is more commonly implied in favour of a grantee against a grantor as a necessary part of an express grant. For example, a quasi-easement has been implied where grantee’s factory unit became virtually unusable without access to the lift: Merrilong Dyeing Works Ltd v Chiu Shu Choi [1984] 1 HKC 535 (CA); Tai Hang Wen Albert v Progressive Group Ltd [1999] 4 HKC 232 (CFI).
