释义 | 反對所有權 An objection raised by a purchaser to the vendor’s title to the land sold. The vendor is obliged to transfer the title described in the contract of sale. Where it is found that there are encumbrances on the title not disclosed by the vendor when entering into the contract of sale, the purchaser may raise such objection: Chow Hai Ping & Anor v Lee Z Z Joseph & Ors [2001] 3 HKC 335, 2 HKLRD 458; Ng King Wai & Anor v Qing Yuan Enterprises Ltd [1999] 2 HKLRD H15. It is also an objection to title if the purchaser insists upon a requisition with respect to a restrictive covenant (Procter v Pugh [1921] 2 Ch 256) or an easement (Ashburner v Sewell [1891] 3 Ch 405) not revealed in the contract of sale. A vendor who had no title at all could not rely on a clause entitling rescission when the purchaser objected to the title: Bowman v Hyland (1878) 8 Ch D 588.
