Lat – to declare. An oral will or declaration by a testator providing for distribution of his or her property on death, not in writing but before a reliable witness. Only wills which are made by soldiers, sailors or airmen in active military service may escape the usual formalities and be valid even if only declared orally. The only requirements are that of deliberate expression of his wishes (Re Vernon (1910) 33 TLR 11); and testamentary intention (Re Knibbs, Flay v Trueman [1962] 2 All ER 829). The testator need not be conscious that he is making his will: Re Stable, Dalrymple v Campbell [1919] P 7. Evidence of statements made by the deceased after executing the will is admissible to prove its contents, but cogent evidence is necessary: Re MacGillivray [1946] 2 All ER 301 (CA).
