释义 | 人體樣本 Biological fluid or tissue taken from a person’s body. At common law, there is no obligation on any person to provide body sample to the authorities: S v S, W v Official Solicitor [1970] 3 All ER 107, [1972] AC 24 (HL). Any right must be derived from enactment. Certain legislation permits the taking of bodily samples: Police Force Ordinance (Cap 232) ss 59, 59A; Independent Commission Against Corruption Ordinance (Cap 204) s 10E; Dangerous Drugs Ordinance (Cap 134) s 54; Road Traffic Ordinance (Cap 374) s 39C. The fact that a bodily sample was obtained by unlawful means does not prevent it being admissible: Chan Chong Yick & Anor v R [1963] HKLR 806.
