| 释义 | 另一人的免責辯護 Something which a defendant sued in respect of tort does in order to defend himself from the legal consequences of the proceedings instituted against him: R v Denton (Inhabitants) (1864) 5 B & S 821; Kwaku Mensah v R [1946] AC 83 (PC). A defence to an action for an intentional tort, that the defendant committed the alleged tort in the reasonable belief that it was necessary to protect the personal safety of another person who was at that time, or was about to become, the victim of the plaintiff’s tort. The defence applies where the defendant has acted to protect relatives; it is probably also available where the person being defended is a stranger.
