释义 | 業主與租客 relationship between the lessor and the lessee that arises out of contract, or in the absence of express agreement, arises from the operation of law or equity, for example, holding over. At common law, the relationship of landlord and tenant is based on contract, when one person, being the landlord, grants to another person, being a tenant, a right to the exclusive possession of land for a term less than that which the landlord has in the land: Halsbury’s Laws of Hong Kong, Vol 17, Landlord and Tenant [235.001]. In Hong Kong, such relationship can also arise under or by reason of statute. It may continue after the expiry of their contractual relationship: Landlord and Tenant (Consolidation) Ordinance (Cap 7) s 117. The landlord and tenant may also be required by statute to enter into a new contractual relationship: s 119P(5)(b).
