| 释义 | 救助協議 An agreement for the provision of salvage services. Save to the extent that a contract otherwise provides expressly or by implication, a master shall have the authority to conclude contracts for salvage operations on behalf of the shipowner: International Convention on Salvage 1989 art 6. The master or shipowner shall have the authority to conclude such contracts on behalf of the owner of the property on board the vessel. The duties to carry out salvage operation to prevent or minimise damage to the environment will not be affected. Since the agreement may be entered at the moment and under the influence of danger, there is a possible risk of inequality of bargaining power. The court has an equitable power to annul or modify the agreement, if (1) the terms of the agreement are considered to be not equitable, or (2) the consent of a party is vitiated by fraud or concealment or undue influence, or (3) the remuneration is excessive: International Convention on Salvage 1989 art 7; Convention for the Unification of Certain Rules of Law Relating to Assistance and Salvage at Sea 1910 art 7. The usual agreement to render salvage services is on a ‘no cure, no pay’ basis: The Goulandris [1927] P 182. The agreement need not be in writing, but it must be clearly proved: The Graces (1844) 2 Wm Rob 214. The most popularly used standard form of agreement of salvage is LOF (Lloyd’s Open Form) 2000.
