| 释义 | 根據可使無效的所有權售賣 A contract for the transfer of goods where the vendor has a title which may be rescinded as being obtained by fraud, misrepresentation, non-disclosure, duress, or undue influence. In such circumstances, where title has not been avoided at the time of sale, a buyer in good faith without notice of the defect acquires good title: Sale of Goods Ordinance (Cap 26) s 25. Where the voidable title is acquired by a fraud perpetrated on the original seller, an innocent third party will acquire good title provided that the original seller has not rescinded prior to the subsale. If the seller has absconded, making communication of rescission by the original seller impossible, the contract will still be rescinded provided that the original seller does everything possible to regain the goods: Car & Universal Finance Co Ltd v Caldwell [1965] 1 QB 525.
