To deprive a person of something which is his or to which he is, or would be, or might be entitled; to injure some proprietary rights of a person: Welham v DPP [1961] AC 103, [1960] 1 All ER 805 (HL). It must involve something more than the mere inducing of a course of action by deceit and ‘defraud’ should not be regarded as synonymous with ‘deceit’: Welham v DPP, supra. It need not be proved that an accused intended to make any personal profit from the deceit, nor that the accused intended to harm the victim. It is sufficient if the victim is deprived of the opportunity to exercise a right in relation to property. See also Deceit; Fraud.
