The geographical scope in which a statute or treaty has application. According to the territorial principle, Hong Kong SAR has the jurisdiction for matters within its autonomy, to prescribe rules and to enforce them over all persons and things within its territorial limits and in all cases: Cia Naviera Vascongada v Cristina, The Cristina [1938] AC 485. The criminal jurisdiction of the courts of Hong Kong is governed by the Criminal Jurisdiction Ordinance (Cap 461). Matters relating to foreign affairs of Hong Kong SAR are the responsibility of the Central People’s Government: Basic Law art 13. International agreements to which the PRC is a party may only be applicable to Hong Kong as decided by the Central People’s Government: art 153. See also Court of record; Offence.
