The adding of accrued interest to the principal of a loan. A bank could therefore levy interest on the capitalised interest as part of the principal, that is, to charge compound interest. This right of a bank has been judicially recognised as an ‘usage of bankers’ and is implied in the banker-customer relationship. However, in a mortgagor and mortgagee relationship, the right to capitalise interest must be found in the mortgage: National Bank of Greece SA v Pinios Shipping Co No 1 (The Maira) [1990] 1 AC 637, [1990] 1 All ER 78 (HL); Nanyang Commercial Bank Ltd v Chan Hon Wing (t/a Kam Wing (HK) Trading Co) & Ors [1989] 1 HKC 256. It is however illegal for other financial institutions like licensed money lenders to make agreements to charge compound interest apart from a provision to charge simple interest on both principal and interest from the date of default: Money Lenders Ordinance (Cap 163) s 22.
