| 释义 | 版權 The exclusive right to reproduce or authorise others to reproduce artistic, dramatic, literary, or musical works. It also extends to sound recordings, films, broadcasts or cable programs and the typographical arrangement of published editions: Copyright Ordinance (Cap 528) s 2(1). It protects the way in which an idea or information is expressed in a material form and not the underlying idea. It is an intangible property right conferred by the Copyright Ordinance. It subsists in a work automatically upon creation of the work without any formalities. No registration is required. There must be evidence to prove that copyright subsists in order for the court to exercise its jurisdiction to make the order of destruction; Such evidence can be proof that the copyright works have been issued to the public: Ho Fei Luen v The Queen [1967] HKLR 495.
