Lat – interest of a term. The right of entry in common law of a lessee in a leasehold given to the lessee prior to his actual possession of the land. The interesse termini is merely a right to enter the land, so in order to secure the full legal benefit of the lease, the tenant has to perfect his title by entry, and until then he has no estate in the land. Where the lease is to take effect at a future date, such a lease is known as a reversionary lease, the tenant only has an interesse termini until he takes actual possession: Halsbury’s Laws of Hong Kong, Vol 17, Landlord and Tenant [235.074]. As to any actions for breach before a tenant’s entry, a tenant may not sue before he is entitled to possession, nor before he has actually entered the premises. This is because the doctrine of interesse termini has not been abolished in Hong Kong, in contrast to the position in England; interesse termini has been abolished in England by the Law of Property Act 1925 (UK) s 149.
