unsworn evidence Evidence given by a child under the age of 14 in a criminal case, which must be given unsworn in accordance with the provisions of the Youth Justice and Criminal Evidence Act 1999. In order to give evidence in criminal proceedings a child must be capable of giving intelligible testimony. The test for unsworn evidence is whether the witness can understand questions put to him and whether he can give answers which can be understood to those questions. |
