departure n. (in civil proceedings) The introduction of a new allegation of fact or the raising of a new ground or claim inconsistent with the party’s earlier claim. Under Part 17 of the Civil Procedure Rules amendments to statements of case may be made with the written consent of all the other parties or with the permission of the court. The court will generally allow amendments so that the real dispute between the parties can be adjudicated upon, provided that any prejudice to the other party caused by the amendment can be compensated for in costs. |
