abuse of a dominant position Anticompetitive practices by a large business. Examples of such activities, which are contrary to Article 102 of the Treaty on the Functioning of the European Union (previously Article 82 Treaty of Rome) and Chapter II of the UK Competition Act 1998, include refusing to supply an existing customer for unjustified reasons and engaging in predatory pricing. The European Commission and/or, the UK Competition and Markets Authority can fine businesses up to 10% of annual worldwide group turnover for breach of Article 102 and/or Chapter II. High fines include €4.34 billion against Google in 2018. In the UK Pfizer was fined £82 million in 2016 for abuse of a dominant position contrary to the Competition Act. |
