exposure n. Under the Sexual Offences Act 2003 (s 66) a person is guilty of exposure if he or she intentionally exposes his or her genitals and intends that someone else will see them and be caused alarm or distress. This will not normally include such activities as nude swimming or sun-bathing, “streaking”, or naked protests and the like. However, where the exposure (by a man or a woman) goes far beyond generally accepted standards of decency and at least two people could have seen it, it may amount to the common-law offence of indecent exposure, even if it cannot be shown that anyone actually saw the exposure or was upset by it. Public nudity may also amount to an offence under the terms of the Public Order Act 1986 (s 5). |
