failure to make disclosure
Failure of a party to disclose documents as required by a direction for disclosure (see disclosure and inspection of documents). This will lead to an application to the court for an order compelling disclosure. Unless the court gives permission under Part 31 of the Civil Procedure Rules, a party may not rely on any document where he has failed to disclose this document or failed to permit inspection by the other party. |
