inspection of property (in civil proceedings) A procedure allowing the High Court or the county courts to order the inspection, preservation, custody, and detention of any property (including land) that is (or may become) the subject matter of proceedings or in respect of which any questions may arise in proceedings (Civil Procedure Rules Part 25). Such an order may be made before the issue of proceedings, in respect of any property that may become the subject matter of subsequent proceedings or which is relevant to issues that will arise in such proceedings. Once proceedings have started, an order may be made in respect of property in the possession of a party, provided that the application is in respect of a physical thing (not details of a manufacturing process, for example), and an order may be made if the property is in the possession of a non-party. In each instance, the order is sought by issuing an application notice supported by evidence. |
