judgment summons A summons, issued on the application of a person entitled to enforce a judgment, that requires a judgment debtor to appear in court. If it can be shown beyond reasonable doubt that the debtor had the means to pay the debt but has failed to do so, the judge may make an order committing him to prison, suspended for as long as specified instalments are paid. Since the virtual abolition of imprisonment for debt, this procedure has been available only in respect of certain maintenance orders and judgments for payment of certain taxes and state contributions. Relevant procedural rules are set out in Schedule 2 to the Civil Procedure Rules. |
